Brasil kittens,help with(straight)relationship lawthingy plz

I know we have smart Brasilian kitties on here. Sorry to call on you but you're my only hope.

My uncle has been scammed for years by a girl living on his money, in his house, he's been paying for her sons education... and now it turns out she has been anything but honest and she broke up with him.

She's been threathening him and demanding a lot of money, basicly the whole value of the house he bought there. She says she has a right to it cause they were engaged (he hasn't been there for more than a few weeks a year and thereLs no legal bond between them besides her living in his house and him sending money and paying her sons school) Only thing my uncle wants to do is pay for the boy's education untill he has to go in the army. After all, it isn't the kids fault and he's hardworking and smart so my uncle will gladly make sure he reaches his potential.

My question is, as I know next to nothing about Brasilian law and I cannot read any kind of portugese, let alone Brasilian portuguese lawbooks:

Is she just saying stuff to scare my uncle into making her a rich bitch or are there any actual rights she has? And if so, what rights?

I mean, she deserves a kick in the hiney for doing this to my sweet, naive uncle! Not a big bonus! The kid will get his education no matter what, my whole family agrees on that, but that woman should get as little as possible, my uncle paid an education for her too, she should just get a job already, she never worked when she was with him.

Any help gladly apreciated :-) plz! He's desperate, he looks so sad and scared of her threaths, when he was always one to enjoy life to the fullest.

Let me see if I can help you (my dad knows something about something, he married some ungrateful woman, so she did the same thing with him ¬¬).

Well, here in Brazil, we have something called 'Civil Union'.. this works to legally unmarried couples (just like anywhere in the world, but gay couples ¬¬) and when they split, one of them can ask for alimony, it´s works just like a divorce.

but it´s harder to prove since, sometimes there´s no legal documents proving the civil union but people can testify about it, and use photos as prove.

well, I think your uncle should find a lawyer.

So, would this civil union thing be legal even if they never requested a civil union?

There are pics of them of course, and the house being in his name and him paying for the kids school and all, so that'd be her proof.
But he has never legally lived in Brasil or spent significant amounts of time there so that'd be his counter argument. The twad made my poor naive uncle sign an agreement to give her a shitload of money though, he now regrets he was threathened into doing that.

Bleh, I suspected it for years and I hate to be right on this one, why would a girl trick someone in such a mean way and not even be true to her golddigging victim, yuck (/rant)

My aunt (my uncles sister) got him a lawyer who'll look into the case but it's hard with the whole language and foreignness thing.

Do you happen to know if that civil union also goes with him being a foreigner and if they haven't been physically living together (more like him spending holidays at his house where she lived year round)

well, if he can prove he signed this document under some kind of threath, the document is invalid.

but it´s up to HER to prove there´s some civil union between them .. and this damn civil code says they don´t need to live together to be in a civil union...

about the house, he bought it before or after meeting her? they bought it together?

I'm not sure about the house, he might have bought it for her (but in his name) or for his previous girl (yes he has been scammed by a girl before, somehow he's too naive to see that hot beachbabes in Fortaleza falling head over heels for an older, european plain John with a stutter spells G-O-L-D-D-I-G-G-E-R it's kinda cute LoL but not very nice for him)

Am quite happy about the document not being valid when signed under threath (she told him "I'm the one looking after the house and the car... *meaningfull silence*")

I so hope this'll all end well, he's just too sweet and naive dating and looking after any young single mom.

anyway, the only thing that he would have to share with her is the house, just check when he bought it ^^

Oh I deff don't think everyone in Brasil is a bitch. I know you aren't and the boy isn't and besides that, "everyone" never is anything. All lezzies aren't bulldykes, all geeks don't wear glasses and so on. One should never judge a group as a whole

Am very glad you helped me out hope my uncle can now have an easy nights sleep again, not worrying about what she'll demand off him cause it now seems clear to me that she can't lawfully put any claim on his stuff overhere or his paycheck in the future, as she tried to have him believe.
